Remedy of Temporary Restraining Order

A TEMPORARY RESTRAINING ORDER (TRO) is a court order of limited duration. A TRO commands the parties in the case to maintain a certain status until the court can hear further evidence and decide whether to issue a preliminary injunction.

A TRO may be issued by a court only if

(1) it appears from specific facts shown in a signed, sworn AFFIDAVIT or complaint that immediate irreparable injury, loss, or damage will result to the applicant before the adverse party or the adverse party’s attorney can be heard in opposition; and

(2) the applicant’s attorney describes to the court in writing the efforts, if any, that have been made to give notice to the adverse party and gives reasons to support the claim that notice should not be required.

Temporary restraining orders are extraordinary measures because they are court orders issued against a party without notice to that party and without giving the party an opportunity to argue against the order.

If an applicant is unable to prove that the harm suffered will be irreparable or that the irreparable harm is imminent, a court will not approve a TRO.

it was my first time to visit my alma mater after I passed the Bar exam. It felt like it was just yesterday when I was in the library and in the Bar review room studying and reviewing for the whole day from 10am to 11pm.

I had a smile when I reached the gate of Polytechnic University of the Philippines (PUP), my picture was there with other fellow Bar passers. I was greeted by some acquaintances and friends, they were even asking me for tips and rubbing me for luck. The feeling was amazing!

It was my first time to file a criminal complaint as a lawyer before the city prosecutor of Quezon City. However, I was guided by an MMDA Consultant in the filing of the complaint. I was a bit tensed since my filing was accompanied by press people. I was asked to be interviewed, but i refused and referred them to our consultant. I was not prepared for that, I dont want to be seen in TV just wearing a T-shirt and refer my self as a lawyer. I think its less respectable. What do you think?

Pre-marking

The case was People vs. Tobera.It was the accused’s turn for the pre-marking of evidence. Atty. Santos was supposed to appear before the branch clerk of court, when he texted me and told me that he will not make it on time. My boss asked me instead to appear in Branch 216 in Quezon City RTC. I asked my boss what will going to happen, and prepared for it, but when I arrived, I was told that the Clerk of Court was on leave. The hearing was rescheduled.

New computer

what they said is true. The hardest part of this freakin’ and crazy bar exam is waiting for the result. And now that the result will be out any day, counting in hours… i do pray that God will give it to me.
